Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and SIA Karto (“Jepex”, “we”, “us”), the company behind Jepex. They govern your use of the Jepex website (jepex.app) and the Jepex applications for macOS and iOS (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. When you create an account we ask you to confirm your acceptance, and we record the version you accepted (the version of this document is shown at the top of this page). If you do not agree, please do not use the Service.

Who can use Jepex

You must be at least 16 years old to create an account or use the Service. By using Jepex you confirm that you meet this requirement and can form a binding contract. If you use Jepex on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.

Your account

You can sign in with a one-time code sent to your email, Apple, or Google. You are responsible for keeping your email account and linked sign-in methods secure and for activity that happens under your account. Please give accurate information and keep it up to date, and tell us promptly at privacy@jepex.app if you suspect unauthorised use of your account.

Licence to use Jepex

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own photography work. We and our licensors retain all rights in the software, design, and brand. Except where the law allows, you may not copy, modify, reverse-engineer, resell, or create derivative works of the Service.

Plans, pricing & billing

Jepex offers a free tier and two paid subscriptions, Recipes and Studio, billed monthly or annually through Stripe. Current prices are shown on our pricing page and at checkout. As of the last update:

• Recipes: €3.99 / month or €19.99 / year
• Studio: €7.99 / month or €39.99 / year
• Free: €0

All prices include applicable VAT. We do not currently offer a free trial; if we introduce trials or promotional prices, the terms shown at checkout apply. If you subscribe through an app store (such as the Apple App Store or Google Play, where available), the store processes your payment and its terms govern billing, cancellation, and refunds for that purchase.

Paid subscriptions renew automatically at the end of each billing period at the then-current price until you cancel, and you authorise us (through Stripe) to charge your payment method for each renewal. You can cancel at any time from the billing portal (Account → Manage subscription). Cancellation stops the next renewal; your plan stays active until the end of the period you have already paid for. We may change prices or plans, and will give you reasonable notice before a change takes effect; a price change applies from your next renewal, and if you do not accept it you can cancel.

Apart from the rights described in the next section and your statutory rights, payments are non-refundable: cancelling stops future renewals rather than refunding periods already paid.

Right of withdrawal

If you are a consumer in the EU/EEA, you normally have 14 days to withdraw from the purchase of digital services without giving a reason.

Because Jepex gives you access immediately, when you subscribe you expressly ask us to start providing the Service right away and acknowledge that you will lose your right of withdrawal once it has been fully provided, and that if you withdraw during the period you agree to pay for the part already provided. To withdraw where the right still applies, use the Withdraw from contract form or email privacy@jepex.app within 14 days of your purchase; we will refund eligible amounts using your original payment method. These statutory rights are in addition to your right to cancel renewal at any time.

Your content

You keep all ownership and copyright in the recipes, photos, descriptions, and other material you create or upload (“Your Content”). We do not claim ownership of Your Content.

So that we can run the Service, you grant SIA Karto a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt (for example, resize images), and display Your Content as needed to operate and provide the Service. For content you keep private, this is the only licence you grant.

Content you publish: licence to us

When you choose to publish a recipe and its attached photos publicly in Jepex, you grant SIA Karto a non-exclusive, royalty-free, worldwide, transferable and sublicensable licence to host, store, reproduce, adapt, translate, publish, publicly display and perform, and create derivative works of that published recipe and its attached photos, in order to (a) operate and provide the Service and (b) promote and market the Service.

The promotional licence in (b) includes the right to feature your published recipe and photos in Jepex marketing materials and on Jepex’s own channels and third-party platforms (including social media such as Instagram, TikTok, YouTube and X), and to let our service providers do so on our behalf. Publishing also means other users can view your recipe, save it to their own collection, and use it for their photography (copies they have saved may remain theirs after you unpublish), and the public can find it. Attribution. When we feature your content in marketing, we will credit you by your Jepex display name (or another identifier you have set), except where a platform’s format makes crediting impracticable.

No fee or pre-approval. This licence is granted free of charge. You waive any right to prior inspection, approval, or compensation for marketing materials that include your published content.

Duration. This licence continues while your content is published. When you unpublish or delete your content, or close your account, the licence ends, except that we may continue to use, and need not recall, any marketing materials already produced or published before you removed your content; except for copies we must keep by law or that remain in routine backups for a limited period; and except for content other users have already relied on through the Service (such as a recipe someone has favourited).

Your promises about Your Content

You represent and warrant that you own or have obtained all rights, licences, consents and permissions necessary to grant the rights above, and that Your Content (including any person, place, trademark or third-party work shown in your photos) does not infringe any third party’s rights, including intellectual-property, privacy, data-protection and personality/image rights. You are responsible for obtaining the consent of any identifiable person shown in your photos to that person’s appearance being published and used as described. You are responsible for what you post.

Indemnity. You agree to defend, indemnify and hold harmless SIA Karto and its officers, employees and service providers from any third-party claim arising out of Your Content, your breach of these representations, or your use of the Service in breach of these Terms.

Takedown. If we receive a credible complaint that Your Content infringes a third party’s rights, or if a person shown in a photo objects, we may remove or stop using the content (including in marketing) without notice.

Your files & camera

The apps work directly on your photo files and, with Studio, on your camera: saving edits modifies or overwrites the JPEG file you chose, and Upload to Camera writes recipe settings to your camera’s custom-settings slots over USB. Both happen only at your direction. Photographs are valuable. Keep backups of your originals. To the extent permitted by law, we are not responsible for changes to files or camera settings made by these features operating as designed at your direction.

Acceptable use

Please do not misuse the Service. In particular, do not:

• break the law or these Terms, or infringe intellectual-property or privacy rights;
• upload content that is unlawful, deceptive, hateful, harassing, sexually exploitative, malware-bearing, or that contains other people’s personal data without their consent;
• attempt to access accounts or data that are not yours;
• probe, scrape, overload, or disrupt the Service, or bypass security or rate limits;
• access the Service by automated means, or extract or re-use a substantial part of its content (including the recipe catalogue), whether for redistribution, a competing service, or training AI or machine-learning models, without our written permission;
• reverse-engineer or copy the software except as the law allows.

Reporting content & takedowns

If you believe content on Jepex is illegal or infringes your rights, email legal@jepex.app with enough detail to identify the content and the problem. We review reports and may remove content or suspend accounts.

Where we remove your content or restrict your account, we will give you a statement of reasons and, where applicable, how to appeal, in line with the EU Digital Services Act.

Copyright. Rights-holders may send a notice to legal@jepex.app identifying the work and the infringing material, with a good-faith statement and contact details. We remove infringing material and terminate repeat infringers. If your content was removed by mistake, you may send a counter-notice.

Intellectual property

“Jepex”, the logo, the applications, the website, and their design are owned by SIA Karto or its licensors and are protected by intellectual-property laws. The Jepex recipe catalogue (the selection, curation, and arrangement of recipes and their data) is protected as a database, and you may not extract or re-use a substantial part of it except as these Terms allow. These Terms do not grant you any right to our trademarks or branding.

Feedback. If you send us ideas, suggestions, or other feedback about Jepex, we may use it without restriction and without any obligation to you.

Availability & changes

We work to keep Jepex available, but we do not guarantee that it will be uninterrupted or error-free. We may add, change, or remove features, may set or change usage limits (for example, the number of recipes, favourites, or photo matches a plan includes), may offer early-access features that can change or be withdrawn, and may suspend the Service for maintenance. The Service relies on third parties (such as Supabase, Stripe, and Cloudflare), and we are not responsible for their services.

Warranties & consumer rights

We provide the Service with reasonable skill and care. For paid digital content and services, EU consumers have statutory rights that what we supply conforms to the contract, and nothing in these Terms limits those rights. Except for those rights and to the extent permitted by law, the Service is provided “as is” without further warranties.

Limitation of liability

To the extent permitted by law, SIA Karto is not liable for indirect or consequential losses, lost data or profits, or matters outside our reasonable control. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for any liability that cannot be excluded under applicable law, including the mandatory statutory rights of EU consumers. Where our liability may lawfully be limited, it is limited to the greater of the amount you paid us in the 12 months before the claim and €50.

Termination

You can stop using Jepex and delete your account at any time. We may suspend or terminate your access if you breach these Terms or where needed to comply with the law. We may also discontinue the Service, or a material part of it, on reasonable advance notice; if you have prepaid for a period beyond the discontinuation date, we will refund that part. On termination your licence ends, but the sections that by their nature should continue (the content licence to the extent described in “Your content”, your representations and the indemnity, intellectual property, warranties, liability, and governing law) survive.

General

Assignment. We may transfer our rights and obligations under these Terms to a company that acquires SIA Karto or the Jepex service (for example, in a merger, acquisition, or sale of assets), provided the transfer does not reduce your rights under these Terms. You may not transfer your account or your rights and obligations under these Terms to anyone else.

Severability. If any provision of these Terms turns out to be invalid or unenforceable, that provision is enforced to the maximum extent permitted and the remaining provisions stay in full force.

No waiver. If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.

Entire agreement. These Terms, together with the Privacy Policy and any terms shown at checkout, are the entire agreement between you and us about the Service.

Governing law & disputes

These Terms are governed by the laws of Latvia. If you are a consumer, you also keep the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts. We would like to resolve any dispute informally first. Please email legal@jepex.app before taking other steps.

Changes to these terms

We may update these Terms from time to time. Each version carries a version date, shown at the top of this page, and the app records which version you accepted. We will post the new version with a revised date and, for material changes, notify you in the app or by email and ask you to accept the updated Terms before you continue using Jepex. For minor changes that do not affect your rights (such as clarifications), continuing to use Jepex after the change takes effect means you accept the updated Terms. If you do not accept an updated version, you can stop using the Service and delete your account at any time.
